Check List of Govt Permissions

Hi Guys,

I am a newbie and the Rodinhoods has given me great confidence that with a forum like this it will be possible for first timers like me to make our ideas see the light of the day.

I am working on an aggregation type e-commerce website. It is under development. It is purely service based. Can you all help me with a checklist of all government permissions and tax registrations required?

I am based out of Navi Mumbai. I have outsourced the development part and we are using the Magento platform.

I am outlining the specific queries which I hope you all with your experience could help resolve.

  1. Is there any mandate as to what should be the nature of the company which is operating an ecommerce web site. i.e can it be a proprietory organisation, or an OPC or an LLP or has it got to be mandatorily a pvt. ltd or ltd. concern? I am asking this as I am the currently the sole person involved and I want to avoid the mandatory obligations of the ltd concerns.
  2. Whilst on the same it should be taken into account that I would need to integrate at least one of the payment gateways. So would they be comfortable dealing with a firm which is not any ltd company?
  3. I initially intend to run the company (website) from my home (SOHO). So again would any govt. agency or the payment gateway be comfortable with this.
  4. Apart from registering with the service tax department would I need any more govt. licenses or permissions, etc.
  5. Do I have to get a “Shops & Establishments” license even if I wish to operate from home?

Do I need any other licenses, permissions or legal obligations to fulfil mandatorily?

  1. Its best to outsource these parts to a good lawyer, just the way you have outsourced your web design. World over, businesses concentrate as much as possible on their core strengths, and outsource the rest.
