I have a question – I was recently investigating the copyright laws in India and it seems that there is a 3 year old backlog for trademarks and wordmarks. Even assuming that Flipkart has a trademark, how are sites like healthkart, lenskart, *.kart working ?
I have seen examples of previous trademark owners objecting to a partial phrase in a name (e.g. “kart”) and I am pretty sure that these guys would not have gone through the whole trademark cycle – so what is actually happening ?
Are they trademarking the logo ? can I infringe on one of these names without any issues ?
FYI – I’m not planning to, but I am looking for the best way to protect my own startup’s name and logo.
