Me and Pavan were pondering over deciding our website domain name and finally got one name which is available after a huge search. But we are stuck over copyright issue if this name is already copyrighted. So give us some insight over copyright in India.
How to check if a title or name is copyrighted or not and what is the procedure and cost of how to file copyright for a name in India?

HI Ankur,
You will have to contact a person who woks with copyright and trademark processes. He will file for the name you wish to trademark and post which you will get a reply from the government, whether the name is already registered or not, and if there are other places in the country using the similar name, then the name cannot be registered since it is a common name.
For Example, Maya, Sitaram, or any other general name cannot be registered due to its use by a lot of outlets.
Where as Cream Centre has its trademarks even on its dishes, you can’t use the same name, as they can sue you 😀

If you are going up against established names then you may have a trademark issue. Smaller firms don’t trademark their names usually so you should be safe. There is no copyright concern with a domain name (I think).
But follow the guidelines for good domain names:
– under 15 characters
– easy to spell – avoid words with ss, ee etc, and easily confused spellings
– should roll off the tongue easily and you should be able to easily picture the spelling in your mind when you speak it.

Domain name is a matter of Trademark.
You can check the name if it is already registered or not @ http://www.ipindia.nic.in go to the public search option(on the left side)write your name and class( class is Classification of goods and services – u will get the list there).

Hi Ankur.
Class is (Classification of goods and services). there r 45 classes, u just go to the trademark public search page.u will see there, class details link. just click that link n see in which number your services or products fall,n then put that number in class.for example.. we r a legal firm so we fall in class 45.
